The Toxic Substances Control Act updated for the 21st Century

On June 22, 2016, President Barack Obama signed the Frank R. Lautenberg Chemical Safety for the 21st Century Act, which amended the Toxic Substances Control Act (TSCA), the nation’s primary chemicals management law.

The new law, which received bipartisan support in both the U.S. House of Representatives and the Senate, included much needed improvements such as:

  • Mandatory requirement for EPA to evaluate existing chemicals with clear and enforceable deadlines;
  • Risk-based chemical assessments;
  • Increased public transparency for chemical information; and
  • Consistent source of funding for EPA to carry out the responsibilities under the new law

In 1976, the U.S. Congress passed the Toxic Substances Control Act (TSCA) which provided the U.S. Environmental Protection Agency (EPA) with authority to require reporting, record-keeping and testing requirements, and restrictions relating to chemical substances and/or mixtures.
