U.S. Congress passed the Plant Patent Act
In 1930, the U.S. Congress passed the Plant Patent Act, recognizing for the first time that plant breeders’ products do not exist in nature and thus should be patentable like other human-made products.
The term “plant” has been interpreted to mean “plant” in the ordinary and accepted sense and not in the strict scientific sense and thus excludes bacteria.
